Terms of Service

Provide full range of services the company "ABC - Server" is based on the above terms and conditions. These rules are mandatory for compliance Subscribers Data Center "ABC - Server".

General provisions

• 1. Common Terminology

  The company "ABC - Server" - referred to as the Contractor.

  Customer service of the company "ABC - Server" - referred to as the Customer.

• 2. User Account

  By registering on our website, the customer provides the complete and accurate information, as well as responsible for the performance of e-mail addresses and mobile phone specified at registration. The email address the Customer provided when registering should be serviced on an external domain, ie, not registered by the Contractor. To exchange information between the Client and the Contractor will use e-mail, only in exceptional cases - mobile communications. Customer must maintain all the contact information up to date. Provision of inaccurate contact information may block the Customer's account.

• 3. Content hosting account.

  All services provided by the Contractor, may only be used for legal purposes. Storage and distribution of any information in violation of the requirements of Ukrainian legislation and international law, is prohibited. The customer automatically agrees that the Contractor has the right to block the customer's account if the materials prohibited to be seen on it (the Customer) account.

  ---

  List of materials, unacceptable on hosting:

  • information, which calls for the overthrow of the constitutional system and violation of territorial integrity of Ukraine, propaganda for war, incitement to racial, ethnic or religious hostility, acts of terrorism;
  • information which contains elements of cruelty, violence, pornography, cynicism, humiliation of human dignity and honor;
  • Websites selling accounts (social media, games, skype, paypal, email accounts, etc.);
  • pirated files of movies, music, books, television, and computer programs (even if the video files and music are on other servers);
  • Websites and forums focused on hackers;
  • torrent trackers;
  • Sites that distribute drugs, or sites promoting such activities;
  • sites that promote illegal activities;
  • pornographic sites, webcam sites, sites of escort services;
  • program to guess passwords, keyloggers;
  • scripts to send spam, sites that promote services for spam;
  • PROXY, VPN or tunnels.

  ---

  Customer agrees not to perform any act aimed at restricting or interfering with access to other users to the services, and not to make unauthorized access to Performer resources and to other systems available on the Internet.

  Artist reserves the right to refuse service. Any material that, in the Contractor's opinion, unacceptable, threatening or defamatory identity containing slander or violating the rules will be removed from the servers or locked with or without notice.

  If the user is not sure that the information on its website complies with the requirements of the Contractor, the user may submit a request to the technical support and get expert advice from the Contractor. The user is solely responsible for all activities that were carried out on its accounts. In particular, when a login and password to the account became known to third parties.

  The user must use all available protection systems that prevent the illegal use of his username and password. In case of unauthorized access to your account Artist restricts access to your account until then, until appropriate measures are taken by the user.

• 4. Use of hosting resources.

  Customer is prohibited:

  •  use for more than 25% of system resources for more than 90 seconds;
  •   use a processor 100 minutes per day (more than 10% of the resources);
  •   launch processes that act as a server;
  •   run any type of the search indexer on shared hosting servers (with the exception of the search engines that index only subscriber sites);
  •   run the software, which interacts with the torrent trackers;
  •   launching game servers;
  •   participating in file-sharing networks;
  •   cron task intervals more than 15 minutes;
  •   execution of SQL queries that run longer than 15 seconds, the correct codes to be used in tables MySQL;
  •   creating a MySQL database containing more than 1,000 tables, or larger than 2 GB, the total volume of all the Customer Database shall not exceed 3GB;
  •   connection to MySQL server not shared hosting servers, such a possibility is available only for database maintenance;
  •   use the URL in the application include function in PHP to connect local files, ie Use include ( 'include.php') instead of include ( 'http://domain.com/include.php');
  •   Disable static file processing control panel using nginx to improve performance.

  ---

  Each file - page site, picture, e-mail message, etc. in Customer account uses one inode (inode - it is a file system object that contains information about a file, directory, etc.). If shared hosting account contains more than 200,000 inode, the Contractor sends the Customer's request to reduce the number of the inode. If action to reduce the number of the inode is not taken, Artist blorkiruet account. Backup accounts that contain more than 200,000 inode or have a volume of more than 10 GB - is not performed, with the exception of database backups that will be created.

  Sites that slightly exceed the limit on the number of the inode, will not be blocked. Accounts that constantly create and delete thousands of files or significantly reduce the performance of the file system will be blocked.

  Artist does not provide technical support and any other customer-reseller customer. If the Customer reseller client will appeal to the Contractor, the Contractor reserves the right to block the customer's account as long as the customer, the reseller will not assume Responsibility for customer service. All questions of end customers who are customer-reseller is unable to resolve on their own may be sent to the Contractor's support, but only through Zakazchka reseller control panel. Customers, resellers are responsible for posted on reseller account data as well as for the acts and violations of the laws of their clients.

• 5. Use of resources VDS / VPS servers.

  VDS / VPS servers services (virtual private server) to be used for lawful purposes only.

  Illegal actions include, but are not limited listed below:

  • sending of viruses or other harmful components;
  •   drugs spreading;
  •   unauthorized access to computer systems;
  •   piracy (distribution of materials protected by copyright in copyright infringement);
  •   conduct gambling, fraud schemes;
  •   sending unsolicited advertisements and information - spam, as well as the use of software for sending mass spam, which creates a large load on the equipment;
  •   use e-mail misuse or non-existent return address;
  •   Any incorrect action that may infringe the rights of third parties. Under the incorrect actions defined as sending private information about a person without their consent, violation of intellectual property rights, libel on the natural or legal person, or any other actions that violate current legislation of Ukraine.
  •   accommodation pornography, any sexually explicit materials, and crack / hack materials;
  •   the use of VDS / VPS servers for organizing torrent trekererov, free / paid to the postal service registration interface organization mailbox directly on the site;
  •   the use of VDS / VPS server to host a proxy server and IRC;
  •   actions that violate the normal functioning of the network elements of the Internet (computers, other hardware or software)
  •   obtaining unauthorized access to the resources of the Internet, followed by the use of such access;
  •   destruction or modification of software and data, not owned by the user, without the consent of the owner of the software or data, or the administrator of this resource;
  •   implementation of actions for the transfer of computer equipment or third parties meaningless or useless information, creating unnecessary (spurious) load on these computers or equipment, as well as intermediate parts of the network, in excess of the minimum necessary to verify network connectivity and availability of its separate elements.
  •   implementation of actions for scanning network nodes in order to identify the internal network structure, security vulnerabilities, lists of open ports and the like, without the express consent of the owner of the resource being tested.

  Artist may refuse to provide services to the Customer if his system (website or any other software) creates a significant load on the server, thereby causing damage to other systems of the server software.

• 6. Delivery Policy for Downloadable Digital Products

  Upon receipt of your order, an email will be sent to you with access to the service. Delivery of the email will mean we deliver the product(s) you purchased.
  If you receive an access email from us, it means we have delivered the item(s) you purchased.
